Patients’ Legal Rights - Have Your Say

The government has announced proposals to extend the NHS Constitution  with new legal rights for patients.

Under the plans, patients will be guaranteed treatment within 18 weeks of referral by a GP, with the right to go to the independent sector if the NHS cannot meet the deadline.

Cancer patients will have a legal right to a maximum wait of two weeks to see a specialist and there will be NHS health checks every five years for 40-74 year olds to assess the risk of heart disease, stroke, diabetes and kidney disease.

As part of the consultation, the government is seeking views on whether patients’ legal rights should be further extended in future, to include rights to choose to die at home, to hold a personal health budget, to see a GP outside office hours and over access to NHS dentistry.
